District Attorney Jan Scully announced today that Domingo Garcia Vargas was convicted by
jury of rape, false imprisonment, infliction of great bodily injury, forcible penetration with a
foreign object, assault with intent to commit forcible penetration with a foreign object and
having committed sexual assaults against two separate victims.
On January 25, 2009, victim K was in the area of 19th and K streets in Sacramento when Vargas
grabbed her, threw her to the ground, punched her in the face multiple times before raping
her. Vargas then fled the scene without being apprehended. Victim K suffered a fractured
bone under her eye, bruising and swelling to her face and mouth and a painful abrasion and
bump on the back of head among other injuries. She submitted to a sexual assault examination
where Vargas’ DNA profile was found.
On June 7, 2009, victim S was in the area of Del Paso Boulevard in Sacramento in her parked
car. She awoke to Vargas on top of her covering her mouth and applying pressure to her
throat. During the attack, Vargas sexually assaulted her. She was able to fight and get out of
her car while Vargas fled on his bicycle. A nearby security guard chased Vargas who
abandoned his bicycle and a backpack. The following day, victim S located a hat in the back
seat of her car which did not belong to her and had not been there prior to the assault.
Forensic testing of the hat by the District Attorney’s Crime Lab revealed Vargas’ DNA profile
as well as his fingerprints on the abandoned bicycle. Vargas’ DNA from the crime scenes were
matched to his DNA in the state DNA database.
Vegas faces in excess of 40 years to life in prison. Sentencing is set for March 25, 2011 at 9:00
a.m. in Department 28 before the Honorable Delbert Oro
