Well, I’m glad THAT’S now cleared up – I for one never knew is WASN’T! But according to the new law passed in Arizona last week – that little missive by the Federal Government has been cleared up – at least in Arizona anyway!
HUH????
According to the analysis of the new Arizona immagration law passed last week, Section 2, subsection (B) which reads …
Requires police officers to make a reasonable attempt to determine the immigration status of a person whenever there is reasonable suspicion that the person is person is unlawfully present and verify that status with the federal government, except to the extent that it would hinder an ongoing investigation.
According to the ACLU of Arizona this section…
Requires all local law enforcement to investigate a person’s immigration status when certain indicators exist that give rise to reasonable suspicion that they are in the country unlawfully, regardless of whether that person is suspected of a crime.
THAT is their words not mine! The ACLU of Arizona doesn’t consider being in this country “unlawfully” a crime in and of itself – and that the ONLY time that the state law enforcement personal should be concerned with that issue is if and when the person is suspected of committing a “REAL” crime!
I find this analysis simply amazing in and of itself! That the ACLU – now feels it is their duty to pick & choose exactly which laws can and cannot be enforced and IF it is enforced by which law enforcement agency!
If we take this ludicrous interpretation to it’s extreme – which most far left interpreters LOVE to do…if an FBI agent witness’s one man killing another – would it be possible for that agent to arrest & detain the perpetrator even though both the perpetrator and the victim lived in the same state in which the killing took place?
OF COURSE THEY CAN make the arrest!
Typically this type of offense is handled under state law – or said to be the jurisdiction of the state. The FBI usually only gets involved if the perpetrator crosses state lines, are there is some other “crossing of state lines” within the criminal act. That does NOT however prohibit the FBI agent from making the arrest and turning the perpetrator over to local authorities when it becomes possible to do so.
So what happens in the case of this Arizona law?
Well -the very next subsection…Section 2, Subsection (C)…
Provides for the transfer of any noncitizen who is unlawfully present to federal custody upon discharge from prison or assessment of a fine after conviction of a state offense.
AND Section 2, Subsection (D) states…
Provides authority for state and local law enforcement to transport noncitizens in their custody suspected of being unlawfully present to federal authorities, even outside the jurisdiction of the local agency.
NEITHER of these is acceptable to the ACLU because they state that federal law already provides resolutions to both of these issues. What the ACLU doesn’t say – is that because of the lack of manpower, funding or plan boredom – the responsible federal agencies – for example – I.C.E. will refuse to take custody of the person – leaving the state holding “a man without a country” – with no where to turn. NOW – with this new law – Arizona is saying – looks – this IS a Federal responsibility – and if ICE won’t take them, then we WILL find another federal agency to take custody and responsibility of this person!
The strangest of all the ACLU objections is to Section 2, Subsection (J)…
Declares that the above provisions shall be implemented in a manner consistent with federal immigration laws and civil rights protections.
The ACLU states, and again, as always I quote…
It is unclear what this provision could mean in practice, since several of the provisions of the bill are facially inconsistent with federal statutes, regulations, and the constitutions of the United States and Arizona.
Well, since it is ONLY the OPINION of the ACLU that “provisions of the bill are facially inconsistent with federal statutes, regulations, and the constitutions of the United States and Arizona.” that the ONLY thing that they are saying via this objection that is factually correct is…
It is unclear what this provision could mean
Because it is painfully obvious that the ACLU is more motivated from a political standpoint – than from a practical, moral and civil liberties standpoint. The mere fact that the ACLU and the United States Government wishes to offer those who violate our borders – and who are therefore criminals by that simple act – more rights & protections than any other citizen of the United States of America is what is un-Constitutional!
Think about it…
1. What criminal in the United States is consistantly allowed to be caught and released over and over and over again – and is only charged with the immigration violation if they are also caught and found guilt of a “more serious” offense?
2. What group of criminals protest the very laws that they have broken, and/or are accused of breaking in broad dailight with no consequenses?
3. What group of criminals are represented by congress members who actually protest on the floor of congress that if we enforce these laws – that families will be broken up?
4. What group of criminals are actually supported by left wing organizations in order to insure their safe passage WHILE they are committing their criminal act?
5. What group of criminals are actually encouraged by their own government to break the laws of their neighbor to the North?
6. What group of criminals own country aids them in their illegal trek by refusing to take seriously the border between the two countries – but when the case is reverse – that very same countries southern border is locked up tighter than a drum in order to prevent illegal immigrants from south & central America from taking advantage of all that Mexico has to offer?
I can go on and on and on with the questions…but the answers will all be the same – and that is the criminals are those who break our immigration laws – unlawful immigrants – or what they used to be called – illegal aliens! This problem will never be solved until and unless we start treating them like the criminals that they are – and treating them exactly like criminals! Yes – most are only breaking the law to make a better life for themselves and their children. But if I said the same thing about Sam down the street – you know the green kid who just robed a liquor store – you would scream bloody murder to throw him jail!
WHY the different reactions?
They BOTH have broken the law – the BOTH deserve to be punished
