ACORN Can Receive Pending Federal Payments, Justice Department Says

David Barron, the acting assistant attorney general for the Office of Legal Counsel, wrote in a memo last month that the ban "should not be read as directing or authorizing HUD to breach a pre-existing binding contractual obligation to make payments to ACORN or its affiliates, subsidiaries or allied organizations where doing so would give rise to contractual liability."

Republicans quickly blasted the ruling that was made public Friday.
"The bipartisan intent of Congress was clear -- no more federal dollars should flow to ACORN," said Rep. Darrell Issa, the top Republican on the House Committee on Oversight and Government Reform.
"It is telling that this administration continues to look for every excuse possible to circumvent the intent of Congress," the California Republican said in a written statement. "Taxpayers should not have to continue subsidizing a criminal enterprise that helped Barack Obama get elected president."
"The politicization of the Justice Department to pay back one of the president's political allies is shameful and amounts to nothing more than old-fashioned cronyism," he added.
The federal government has poured about $53 million into The Association of Community Organizations for Reform Now since 1994, mostly in grants from the Department of Housing and Urban Development for affordable housing services.
But the group has been brought to its knees in recent months following the release of undercover videos showing a couple posing as a pimp and prostitute receiving advice from ACORN employees on how to skirt tax laws and acquire illegal home loans to establish a brothel that could house underage girls who illegally crossed the border.
Footage showed staffers advising the "pimp" and "prostitute" on how to falsify tax forms and seek illegal benefits for 13 "very young" girls from El Salvador that the pair said they wanted to bring to the country to work as child prostitutes. The videos set off a firestorm in Congress.
ACORN pledged an internal inquiry and fired the staffers who were caught on tape, but it was only the latest of many legal troubles for the group.
Republicans led the charge to ban all federal funding to the group as the Obama administration quickly distanced itself from the group.
ACORN has fought back, filing a lawsuit against the government in an attempt to regain the millions of dollars in funding Congress voted to block after the undercover videos were released in September.
The suit charges Congress with violating the Constitution when it passed legislation in September that specifically targeted ACORN to lose federal housing, education and transportation funds.
ACORN claims it has been badly hurt by the congressional actions and has had to fire workers and close some of its 1,200 branches around the country.
Though it remains unclear precisely how much money the national organization was receiving from federal sources and aid programs, a lawyer pressing the suit said ACORN has already lost an amount "in the millions" since the freeze took effect.

I don't care what sort of politics, any organization which receives any type governmental funds should stay out of politics, or lose the funding altogether.

A handful of House Republicans did their best on Tuesday to shame Democrats and the Obama administration for its supposed connections to the controversial anti-poverty group ACORN.
Republicans also voiced complaints that Democrats are not moving forward with investigations into the organization that is alleged to have committed widespread voter fraud to support Democratic candidates, in violation of the group's tax-exempt status.
"ACORN is a wholly-owned subsidiary of the Democratic Party," Rep. Darrell Issa, R-Calif., said at Tuesday's two-hour long partisan forum attended by eight Republicans but no Democrats.
Another source of frustration for Republicans is a legal decision from the Justice Department, made public last week, that says officials at Housing and Urban Development can honor its existing contracts with ACORN despite a recently passed law forbidding federal funds from going to the group.
Congress banned federal funding to ACORN after members of the group were caught in an undercover video offering advice on how to evade tax laws to a couple posing as a pimp and prostitute.
"The White House will do everything it can to make sure ACORN will continue to get federal funding," Rep. Dan Burton, R-Ind., exclaimed.
Rep. Steve King, R-Iowa, who was dubbed the "ACORN king" because of the bucket of acorns displayed prominently by his side, said he's convinced that any investigation of ACORN will reflect poorly on the Obama administration.
"These roads will lead to the White House," King asserted.
But one of the panel's guest speakers said there's no evidence to suggest there's an ongoing FBI or Justice Department investigation. Hans von Spakovsky of the Heritage Foundation suggested that if the allegations made against ACORN were lodged against a mortgage company, there'd be great fanfare from Attorney General Eric Holder.
A Justice Department spokesman simply said "we decline comment" when asked about plans to investigate ACORN.
The lawmakers also heard from Anita MonCrief, a former ACORN worker-turned- whistleblower who said she saw organized illegal activity in what she described as a "culture of dishonesty." She talked about how ACORN was armed with a list of "maxed out" Obama campaign donors who were solicited for funds to help voter registration efforts.
MonCreif also discussed how the voter registration workers were pressured to meet daily quotas and even threatened with prosecution if they failed to keep pace.
"The poor will be better served when ACORN is no longer the go-to place for the poor," Issa declared.
Indiana Secretary of State Todd Rokita blamed ACORN for producing hundreds of bogus registration in just one Northern Indiana County.
Rokita, a Republican, said the problem of intentional fraudulent voter registration threatens to undermine the democratic process.
"This is an American issue," he said. "This is a constitutional issue. Americans should be mad."
Representatives from several House Democratic offices did not immediately respond to Fox News' questions about the Republican forum.

I remember when the main difference between Democrats and Republicans was high taxes vs. low taxes, labor vs. management, etc. I never remember the day when mainstream Democrats would condone child enslavement, trafficking and rape.

How can such a deep moral divide ever be healed? How do you "reach out" to people who condone child rape and enslavement?

They just refuse to acknowledge that it exists in the numbers that it does. Or will say that others are doing it also, and by saying that they mean they are no different than anyone else. It is a third world mentality.

Years ago, Barney Frank was "censured" by the House for "fixing" parking tickets for his gay room mate. It turned out the gay room mate was running a homosexual prostitution ring out of their apartment and he got the parking tickets while hanging around local schools, recruiting school children for the ring. This latter fact was ignored by the media.

In viewing the ACORN tapes I was a little stunned at how relaxed and effortless the ACORN workers seemed to be in responding to the "pimp" and his request for assistance with this kind of thing. It's like they do it all the time and this is just another "day in the life." It was also a little unnerving that all the ACORN people were black or hispanic, people who are always railing about "white racism" and "white privilege" and "slavery and Jim Crow."

The tape of the San Diego ACORN incident showed a male Hispanic ACORN worker who jumped at the idea of helping to enslave and rape 15 year old Hispanic girls (from El Salvador) even volunteering to use one of his "contacts" to help smuggle them into the country.

These people are not from the third world, but are Americans who were born and raised here. There is something more than just a "third world mentality." Do the billionaires who run the Main Stream Media, that has completely ignored the story, also have a third world mentality? There is something very ugly and very troubling about this, especially when it was known to all of the congress and they're still willing to fund this organization.

I have never personally known anyone who would go along with this kind of thing and I doubt any of you have either. Yet virtually the entire Congress and the President and U.S. Attorney General, not to mention state attorneys general and local prosecutors, are willing to just blow it off. This reflects a level of evil and corruption that I did not think possible, even for liberals. And frankly, the GOP should have been making noises about this before now.

If these monsters will condone the enslavement and raping of children, is anything off limits? My heart has never been this heavy. Something really terrible has happened. Most people never noticed and those who did are numbed by corruption or indifference.

House Republicans accused the Obama administration Tuesday of covering up criminal activities committed by the embattled community activist group ACORN, saying that the president has used the group as an illegal political tool to help himself and other Democrats get elected.
"The current administration is fast becoming, in reality, the war room of ACORN's political machine," said Rep. Darrell Issa, California Republican. "I am concerned that the era of corruption promulgated by ACORN and protected by the White House is just the beginning."
The top Republican on the House Oversight and Government Reform Committee, said ACORN has engaged in "illegal, partisan activities designed to help individual Democratic members."
"This (action) goes from city councilmen to state assemblymen all the way to President Barack Obama," he said.
Rep. Lamar Smith of Texas, the top Republican on the House Judiciary Committee, said Mr. Obama's past ties to the Association of Community Organizations for Reform Now (ACORN) will "taint any conclusions" by any Justice Department probe into the group.
Mr. Issa and Mr. Smith made their remarks at a Capitol Hill forum on ACORN that they sponsored. The event was attended by a handful of House Republicans but no Democrats.
Congressional Democrats, while condemning many of ACORN's practices, see no illegal ties between the group and the White House.
Many of the Republican lawmakers used the event to try to link the White House to ACORN - a group under intense scrutiny after hidden-camera videos showed its workers advising a woman posing as a prostitute how to cheat on taxes and loan applications.
The liberal organization also has been accused of voter registration fraud that benefited Democratic candidates in several states.
Mr. Obama served as an ACORN lawyer during his years as a community organizer in Chicago but has cut ties with the group since elected as president.
"When this investigation is finally finished ... these roads following ACORN will lead to the White House," said Rep. Steve King, Iowa Republican.
Republicans have pressed the Justice Department and the FBI to conduct a comprehensive investigation of ACORN. They are upset that the Democrat-controlled Congress hasn't launched its own probe.
Congress recently canceled federal funding to ACORN and its affiliated organizations. But the Justice Department released a memo last week concluding that the government should pay ACORN for contracts that were in place before Congress passed the law.

As long as Holder is in charge over there you can bet that he will do exactly what he is ordered to do

Not go after acorn
allow black panthers to threaten voters
and any number of things that he should be held accountable for

We are in serious trouble folks , I just hope in the near future these idiots have to defend their illegal and outrageous actions before the American people.
