Default E-Verify expected to be mandatory

The Hemet City Council is expected to approve a new ordinance tonight that will require businesses in the city to verify that all newly hired employees are legally allowed to work in the United States.

The move comes after several months of public comments at council meetings aimed at spurring the city to require businesses to use E-Verify.

The city has been considering requiring E-Verify, a free service run by the Department of Homeland Security and the Social Security Administration, since it backed Arizona's anti-illegal immigration law a year ago.

"I'm definitely in favor of it," Vice Mayor Robert Youssef said. "E-Verify is basically enforcing what's already in place.

"We want to make sure our citizens who have the ability to work, can find work. E-Verify isn't going to catch everything, but it's another tool to use to make sure our employers are building relationships with the people who have the (legal) ability to work."

Hemet's ordinance mirrors one passed in Temecula last July. Temecula is one of many cities in the Inland area -- and nearly every city in southwest Riverside County -- that require that businesses use E-Verify. Wildomar requires only that businesses that have contracts with the city use it.

Under the proposed ordinance, if Hemet found that a business did not use E-Verify or has hired an undocumented worker, the city could demand that the employee is terminated. If a business has a second violation within two years, it could have its business license revoked.

The ordinance does not allow for civil or criminal penalties. The ordinance would apply to anyone hired after June 9.

"I am confident that most of the businesses here in Hemet are (already) compliant," City Manager Brian Nakamura said. "It's important that our businesses do support our local economy.

"We want to make sure that we are serving the interests of the citizens and the businesses that support us."
