Default Arnold Appoints 16 Year Old To Board Of Education

I did not know Arnie could get any worse but I guess he just did. I have to admit an 18 yr old ran for City Council in my city. He did not even make a blip in the election.

As lunatic as it is to add more children to the legal mix in Sacramento (this one just happens to be underage, opposed to most of the others she has a valid reason to be juvenile), it is the law.

I called Schwartzenegger's office and got that answer. The aid, who sounded quite young himself, advised me that the specific code could be found in leginfo.ca.gov .

That page looked like it would take quite a bit of wading, so took another route and while I haven't found the specific code yet, I found this:

Interested students who will be high school seniors in good standing in any California public high school during the 2010-2011 school year and who will be available to attend a state-wide conference the first weekend of November (November 15-18, 2009) are invited to apply for the position of Student Member on the California State Board of Education. The student who is appointed to the position by the Governor will:

***Before completing the application, please read the description of the position carefully.* Each prospective applicant should (1) fully understand the time requirement that serving on the SBE would add to his or her workload and schedule and (2) give serious consideration to the frequent travel requirements of the position. If you qualify for the Student Member position and wish to apply, here's what you need to do to complete your application package:

Complete the application form.
Include no more than three letters of recommendation. At least one letter must be from a current or former teacher and one letter from an administrator or counselor at your high school. All the letters should be from individuals who know you personally and include comments on your academic and leadership abilities, as well as the writers’ perspectives regarding you as a potential member of the SBE. (If a writer wishes to send a letter directly to the Board Office, please be sure that the letter is mailed on or before the application deadline.)

Include a copy of your school transcript.

Include supplemental items, such as news clippings, if you wish.

Submit all materials at one time, except for letters of recommendation that the writers wish to submit separately.

Appointment Process

Initial screening. The SBE’s Screening Committee will review all applications and select twelve semifinalists from among the applicants. (Typically more than 150 applications are received.) The decision of the screening committee is final.

Presentation and selection of candidates. California Law requires that school district governing board student members select six of the 12 semifinalists for further consideration by the SBE. The SBE uses the annual Student Advisory Board on Education (SABE) conference to perform this function. The twelve semifinalists will attend the 2010-11 Student Advisory Board on Education (SABE) Conference, to be held in Sacramento in November, 2009.* The semifinalists will participate in all SABE activities. In addition, the semifinalists will make individual presentations to all other SABE participants about their interest in, and qualifications for, the student member position. Following a secret ballot by the SABE participants, the names of six candidates will be submitted for further consideration by the SBE’s Screening Committee. The decision of the SABE participants is final.

Interview. Each of the final six candidates will be interviewed by the SBE’s Screening Committee. The Screening Committee will recommend three finalists to the SBE. Following the Board’s action to select the three finalists, the names of the three finalists will be sent to the Governor. The SBE’s recommendations to the Governor are final. Interviews and the selection of three finalists will occur at the SBE’s November 18-19, 2009, meeting.

Appointment. Representatives of the Governor will interview the three finalists, probably in the late spring or summer of 2010. Following that, one of the finalists will be appointed by the Governor to be the 2010-2011 Student Member.*

*All travel, conference, and hotel costs directly associated with the Student Member selection process will be paid.

This seems to be disregarded, particularly with the "dual immersion" crap.

Federal law does not require primary language instruction or any other specific methodology. "Appropriate action" is determined using the three part analysis developed in Castaneda v. Pickard (5th cir. 1981) 648 F.2d 989 as follows:
Use sound theory . The educational theory upon which instruction is based must be recognized as sound by at least some experts in the field.
Provide adequate support . The school system must provide the procedures, resources, and personnel necessary to apply the theory in the classroom. The resulting program must be implemented effectively.
Achieve results . After a reasonable period of time, application of the program must actually overcome English language barriers confronting the students and must not leave them with substantive academic deficits...

State Law. The specific programmatic provisions of California's "bilingual education" program became inoperative on June 30, 1987...

Immigrant Children (hereafter Section 300, et. seq.). Education Code Section 300 clearly states that the purpose of the new law is to teach English as rapidly and effectively as possible to English learners in California public schools. The State Board of Education finds that this policy illustrates how these three components of substantive law may be harmonized to create a single system governing programs for English learners that emphasizes the rapid, effective, and efficient acquisition of English literacy, specifically including the ability to read and write in the English language...

Goals and Principles Not Binding on School Districts

In keeping with Education Code Section 33308.5, the State Board of Education makes clear that the guidance provided above is advisory in nature and only the requirements of federal law, Education Code Section 300 et seq. and the funding provision of Education Code Section 62002 (and, where applicable, court decisions) are binding upon school districts as they develop and implement educational programs and services for English learners.
