Judges are the ones who decide legal questions, such as what is "constitutional".
The two to one public backing for 1070 is meaningless unless the judiciary ultimately agrees with 1070 within the Supreme Court.
How do we balance the larger issue of potential legislative abuse by tyranny of the majority while retaining genuine constitutional protections while finding a way to alleviate judicial abuse by deep sixing activist judges?
